In view of:

Decree of the Minister of Industry and Trade No. 61/MPP/Kep/2/2004 on inter-insular trade of sugar;

DECIDES:

To stipulate:

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE AMENDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 61/MPP/Kep/2/2004 CONCERNING INTER INSULAR TRADE OF SUGAR.

Article I

Several provisions in Decree of the Minister of Industry and Trade No. 61/MPP/Kep/2/2004 on inter-insular trade of sugar are amended as follows:

1. To amend the provision in Article 2 so as to entirely read as follows:

"Article 2

(1) Sugar, which can be traded between islands includes:

(2) The sugar as meant in paragraph (1) letter c only can be traded directly between regions for food, beverage or pharmaceutical industries."

2. To amend the provision in Article 3 so as to entirely read as follows:

"Article 3

Sugar prohibited from getting traded between islands includes:

3. To amend the provision in Article 4 so as to entirely read as follows:

"Article 4

(1) The sugar as meant in Article 2 paragraph (1) letters a and b only can be traded between islands by PGAPT.

(2) The sugar as meant in Article 2 paragraph (1) letter c can be traded between islands by refinery industry or PGAPT.

(3) Recognition as PGAPT as meant in paragraphs (1) and (2) is given by the Director General.

(4) The model of document of PGAPT as meant in paragraph (1) is as contained in Attachment I to this decree."

4. To amend the provision in Article 5 so as to entirely read as follows:

"Article 5

(1) In realizing the inter-insular trade of sugar as meant in Article 4 paragraph (1), PGAPT must be attached by SPPGAP from the Director General.

(2) SPPGAP as meant in paragraph (1) contains information at least kind, quantity, region of origin, destination region, sending PGAPT and receiving distributor.

(3) In order to obtain SPPGAP as meant in paragraph (1), application of PGAPT must be accompanied by the following documents:

(4) The model of document of SPPGAP as meant in paragraph (1) is contained in Attachment II to this decree.

(5) In realizing the inter-insular trade of refined sugar by refinery industry or PGAPT as meant in Article 4 paragraph (2), Approval of Inter-Insular Trade of Refined Sugar (SPPGRAP) from the Director General must be enclosed.

(6) SPPGRAP as meant in paragraph (5) contains information, at least, kind, name and address of refined sugar mill, as well as name and address of using/ receiving manufactures in the destination region.

(7) In order to obtain SPPGRAP as meant in paragraph (5), application of refined sugar mill must mention:

and must enclose the following documents:

(8) Besides fulfilling the requirements as meant in paragraph (7), PGAPT trading refined sugar between islands must enclose original statement from refined sugar industry, certifying that the refined sugar to be traded between islands by PGAPT really comes from the relevant refined sugar mill.

(9) The model of document of SPPGRAP as meant in paragraph (1) is as contained in Attachment III to this decree."

Article II

The decree comes into force as from the date of stipulation.

For public cognizance, the decree shall be published by placing it in State Gazette of the Republic of Indonesia.
